Cultural Sound Lab is a platform that enables traditional musicians and communities to upload, protect, license, and monetize their cultural music. The Service includes audio fingerprinting, licensing management, royalty distribution, and music discovery features.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

4. Content Ownership and Rights

Your Content: You retain ownership of all content you upload. By uploading content, you grant us a non-exclusive license to:

Host, store, and display your content
Generate audio fingerprints for copyright protection
Distribute your content according to your licensing preferences
Promote your content on our platform and marketing channels

Representations: You represent that you have all necessary rights to upload content and that it does not infringe any third-party rights.

5. Cultural Protocols

We respect cultural protocols and restrictions on traditional music. When uploading content, you may specify cultural protocols that will be enforced through our licensing system. Licensees agree to honor these protocols as a condition of their license.

6. Licensing

For Uploaders: You set the licensing terms and pricing for your content. We facilitate transactions and handle royalty distribution according to your specified ownership structure.

For Licensees: When you purchase a license, you receive the rights specified in that license type. You must comply with all terms including attribution requirements and cultural protocols.

7. Payments and Fees

We process payments through Razorpay. By using our payment features, you also agree to Razorpay's terms of service.

Platform fee: We retain a percentage of each transaction
Royalty distribution: Handled according to ownership structure
Refunds: Generally not available for digital licenses
Taxes: You are responsible for applicable taxes

8. Prohibited Conduct

You agree not to:

Upload content you don't have rights to share
Violate any cultural protocols or restrictions
Use the Service for illegal purposes
Attempt to circumvent our security measures
Scrape or harvest data from the Service
Use licensed content beyond the scope of your license
Misrepresent your identity or affiliations

9. Audio Fingerprinting and Copyright

We generate audio fingerprints for all uploaded content to enable copyright protection. By uploading content, you consent to fingerprint generation and potential sharing with partner platforms for enforcement purposes. We may also use fingerprinting to detect unauthorized use of your content.

10. AI Training Opt-Out

You may opt out of having your content used for AI training purposes. This preference is recorded and we make reasonable efforts to enforce it, though we cannot guarantee third parties will comply.

11. Termination

We may terminate or suspend your account at any time for violations of these terms. You may delete your account at any time. Upon termination, your license to use the Service ends, but existing licenses granted to others remain valid.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR THIRD-PARTY ACTIONS REGARDING YOUR CONTENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

14. Indemnification

You agree to indemnify and hold harmless Cultural Sound Lab from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.

15. Changes to Terms

We may modify these terms at any time. We will notify users of material changes. Continued use of the Service after changes constitutes acceptance of the modified terms.

16. Governing Law

These terms are governed by the laws of India. Any disputes shall be resolved in the courts of India.
